Jessica Cottey is an Associate with Gjerset & Lorenz, LLP. Dr. Cottey focuses on assisting physicians and hospitals in a variety of regulatory, compliance, and transactional matters.

Representative Experience
Dr. Cottey’s experience assisting health care providers with regulatory, transactional and operational issues includes:

• Advising health care providers regarding compliance with the Stark law and federal and state anti-kickback laws.
• Representing healthcare entities in connection with the structuring and development of numerous joint ventures, including physician-owned specialty hospitals and imaging and radiation therapy facilities.
• Advising on the licensure requirements for the practice of medicine in Texas and other states.
• Advising health care providers regarding Texas’ prohibition on the corporate practice of medicine and the necessity for, and formation and maintenance of, certified health organizations through the Texas Medical Board.
• Negotiation of physician services contracts for hospitals and physicians.
• Representing hospitals in alleged patient dumping violations, involving civil money penalties assessed by the Office of the Inspector General. 
• Drafting lease agreements, management agreements, asset purchase agreements, and promissory notes related to transfer of ownership interest for hospitals.
• Assisting in the creation and development of Medicaid supplemental payment programs for hospitals in Texas.
• Advising hospitals regarding Medicaid Disproportionate Share hospital funding compliance reporting and appeals.
