Provider Operations

Gjerset & Lorenz assists clients with a full range of operational issues. Our attorneys address providers’ day-to-day questions relating to patient rights, admission and discharge requirements, patient transfers, confidentiality of patient information, and fraud and abuse laws. We represent hospitals, medical groups and individual practitioners in all aspects of provider licensing, credentialing and accreditation. Examples of these services include:

  • Negotiating and drafting contracts between physicians and providers, including employment contracts, professional services agreements, directorship agreements, relocation agreements, management services agreements, research agreements, and fellowship agreements in standard and academic medical center settings.
  • Preparation and review of policies and procedures for peer review, quality assurance, risk management, private investments, charity care, bad debt collection and compliance with fraud and abuse laws.
  • Representation of providers in a variety of state and federal licensing issues involving entities ranging from the Centers for Medicare and Medicaid Services and state health departments, to private credentialing agencies such as the Joint Commission on Accreditation of Healthcare Organizations.
  • Development and implementation of contract negotiation policies and procedures.
  • Compliance with charity care requirements for tax-exempt hospitals and hospitals receiving governmental subsidies for indigent care.
  • Medicare and Medicaid certification, accreditation, and compliance with various conditions of participation.
  • Negotiating and drafting contracts with a variety of payors, including private, state and federal payment sources. Our experience in this regard ranges from representing public and private institutional providers to ancillary providers to individual providers.
