James T. Lindsey
James T. Lindsey is a partner with Gjerset & Lorenz, LLP. James advises a variety of healthcare organizations on matters related to healthcare finance, reimbursement, state and federal regulatory compliance, and business transactions.
James has extensive experience advising various types of healthcare providers, associations and government agencies regarding the development, operation and financing requirements for governmental reimbursement programs. This includes vast experience on matters related to disproportionate share hospital programs, upper payment limit demonstrations, Medicaid managed care directed payment and value based purchasing programs, Section 1115 and 1915(b) waivers, graduate medical education programs, Medicaid and Medicare cost reporting, trauma programs, healthcare related taxes, intergovernmental transfers, and certified public expenditures. His breadth of work on these matters ranges from providing regulatory compliance and policy guidance, developing financial models and analysis needed to operationalize new programs or assess the impact of changes to existing programs, developing programmatic documents needed to secure state and federal approvals, to representing individual organizations on detailed financial reporting matters related to participation and audit requirements for governmental programs.
James’s regulatory compliance practice also includes advising healthcare providers on matters related to financial assistance policies, charity care policies, state and federal licensure requirements, patient record/billing requirements, local indigent care programs, stark and anti-kickback law, administrative audits and appeals, as well as income taxation and corporate practice of medicine laws.
James’ business transactions practice includes many years of experience performing due diligence reviews, drafting/negotiating provider service agreements and payor contracts, and developing transactional documents related to the acquisition of hospital systems, clinics, EMS companies and physician practices, as well as the creation of joint ventures and new healthcare companies.
Prior to his experience working with Gjerset & Lorenz, LLP, James was a law clerk for the U.S. Attorney's Office for the Western District of Texas and a senior management consultant for IBM Global Business Services. During his time with IBM, James’ consulting practice included advising numerous Fortune 500 companies regarding strategies for improving operational efficiencies in the areas of supply chain management, product life cycle management and pricing through advanced analytics, restructuring existing business processes, consolidating/integrating core enterprise functions and the implementation of information technology systems.
