Overview

Jared Konczal is a partner with Gjerset & Lorenz, LLP.  Mr. Konczal focuses his practice on counseling institutional healthcare providers on transactional, state and federal regulatory, and reimbursement matters related to governmental reimbursement programs and the implementation, operation, and maintenance of collaborations between public and private healthcare providers.

Mr. Konczal has:

  • Provided financial and legal analyses to hospitals regarding their participation in all Medicaid supplemental payment programs. Such programs include:
    • 1115 Waiver Uncompensated Care programs;
    • Medicaid Disproportionate Share Hospital programs;
    • Medicaid fee-for service (Upper Payment Limit) programs;
    • Medicaid Managed Care Directed Payment programs; and
    • Medicaid Managed Care Quality Incentive Arrangement programs.
  • Assisted providers with financial forecasting and budgeting for each of these programs, including developing financial models to project impacts of future program years, new programs in development, and changes in existing programs.
  • Analyzed hospital utilization data to assist hospitals with Medicaid Disproportionate Share Hospital and Uncompensated Care program qualification and funding, and assisted hospitals in maintaining compliance with program participation, resolving agency issues, and participating in federally-mandated audits.
  • Analyzed hospital utilization data to develop hospital-specific average commercial rate data reporting necessary for participation in Medicaid Managed Care Directed Payment programs.
  • Represented clients by providing subject matter support for discussions with state agencies and trade associations to develop, implement, and maintain Medicaid Managed Care Directed Payment programs, and address changes in federal law and guidance affecting program operations.
  • Drafted lease and management agreements, healthcare provider contracts, service coverage agreements, and corporate documents associated with non-profit healthcare corporations.
  • Advised hospitals in their participation in state and local indigent care programs.
  • Assisted in due diligence analysis for hospital acquisitions related to Medicaid supplemental payment programs and structural issues to continue participation in such programs post-acquisition.
  • Negotiated and drafted contracts to effectuate state-directed hospital rate increases and create ancillary quality improvement incentive arrangements between hospitals and managed care organizations.
  • Assessed changes in state and federal Medicaid laws and advised hospitals on regulatory and reimbursement impacts of changes, and drafted advocacy materials and comments to proposed and adopted state and federal rules implicating Medicaid supplemental payment programs.
  • Assisted hospitals and governmental entities with designing, implementing, and participating in local healthcare provider taxes, including drafting implementation and operational materials, presenting technical testimony at state and local government hearings, and collaborating with client advocacy experts to create a local healthcare provider tax tailored for operating in rural communities.

Before beginning his legal career with Gjerset & Lorenz, LLP, Mr. Konczal worked in the research & policy department of the Ewing Marion Kauffman Foundation, conducting research on entrepreneurship and innovation policy and managing research grant programs.
